FORMAL ADMINISTRATIVE TRANSMISSION: EXHIBIT G-7TO: Marc Bergin, Chief of Staff; John Clark, Director of Safety & Security CC: Dr. Aaron Spence Superintendent; Loudoun County School Board; Loudoun County Sheriff's Office; Leesburg Police Department; U.S. Department of Education, Office for Civil Rights (OCR); Dr. Kate Ridgeway, Principal DATE: August 11, 2026 SUBJECT: ADMINISTRATIVE DEPOSIT OF EXHIBIT G-7 — FORMAL OPT-OUT OF SECOND STEP CURRICULUM AND NOTICE OF UNAPPROVED THIRD-PARTY DATA PROCESSING Mr. Bergin, Mr. Clark, and Division Counsel, Please find attached Forensic Exhibit G-7 (260810 Gmail - Second Step Family Access.pdf), received by the Complainant from Lowes Island Elementary School Principal Dr. Kate Ridgeway on August 10, 2026. This transmission forensically establishes the following administrative defaults and statutory violations: FORMAL CURRICULUM OPT-OUT DIRECTIVE: As joint legal custodian, the Complainant hereby issues an explicit, binding OPT-OUT DIRECTIVE for minor children Beau Rubis and Charles Rubis regarding any participation in, assessment under, or exposure to the "Second Step" digital program or associated Committee for Children materials. LCPS is explicitly prohibited from registering, tracking, or subjecting the minor children to non-academic social-emotional survey tools without express written consent. Prohibition of Third-Party Data Transmission: LCPS is instructed to refrain from transmitting student data or family identifiers to external vendors (including Committee for Children) under the district's pilot license. Continuous Administrative Default & NTO Pretext: Directing a parent to create third-party vendor accounts and manage digital activation keys while actively maintaining a division-wide No-Trespass Order (NTO) demonstrates the complete absence of a safety predicate and confirms that the NTO serves solely as an illegal administrative blockade.
REITERATED MANDATORY REMEDIESImmediate Rescission of the Retaliatory NTO: Formally vacate the February 24, 2026 order signed by Director John Clark, dissolve the digital blockade, and restore unhindered joint legal custodial access to all physical and digital educational portals. Immediate Termination Proceedings: Initiate termination proceedings for Seneca Ridge MS Principal Nick Cottone and Director of Safety & Security John Clark for bad-faith retaliation, civil rights violations, and abuse of authority under color of state law. Procurement Integrity Debarment (Policy 2350): Enforce LCPS Policy 2350 to immediately terminate all commercial sponsorships with Khanna Law, PLLC, on the Lowes Island Elementary PTO platform and initiate debarment proceedings against software vendor QlikTech. Delivery of Converted Public Records: Secure the immediate, unhindered transmission of all 1,141 responsive VFOIA records owed across multiple requests, for which processing fees were paid and accepted. Notice of Accrued Claim for Damages: Formal notice of ongoing, accrued damages in the amount of $2,148,000.00 and continuing, resulting from bad-faith civil rights violations, custodial deprivation, and administrative conversion of public assets.
