Beyond FOIA: Documenting a Disturbing Pattern of Retaliation and Administrative Obstruction

Introduction:

Recent events surrounding my ongoing interactions with Loudoun County Public Schools (LCPS) have unfortunately revealed a pattern that goes far beyond simple administrative delays or misunderstandings regarding public records requests. What has emerged is documentation suggesting a coordinated effort involving state actors and private interests, seemingly designed to obstruct legitimate oversight, suppress information, and even interfere with fundamental parental rights. This post aims to provide a clear, factual overview of this troubling trajectory, supported by the growing administrative and legal record.

Section 1: The FOIA Default and the Admission of a Nexus

The foundation of this issue lies in persistent FOIA requests aimed at understanding LCPS's relationship with certain private entities and individuals. Following significant delays and confusing communication, LCPS has now formally defaulted on multiple requests. Crucially, in a recent response regarding correspondence with private attorney Lindsay Mohler and attorneys of Troxel Leigh P.C., LCPS explicitly claimed Attorney-Client Privilege over 172 pages of emails.

Since Ms. Mohler is a private attorney representing a third party and is not employed by or representing LCPS, this assertion of privilege is legally questionable at best. 

Forensically, however, it serves as a prima facie admission of a Public-Private Nexus—a direct line of communication and potential coordination between a public school district and a private legal representative regarding matters that appear, on their face, to be purely civil. This admission strongly suggests that public resources, including administrative time and potentially legal counsel, are being utilized to facilitate private legal interests.

Section 2: The "No-Trespass" Order as a Retaliatory Tool

The most visible manifestation of this apparent coordination is the No-Trespass order issued against me. 

While ostensibly for "safety," the timeline and circumstances surrounding its issuance and subsequent expansion strongly suggest otherwise.

  • Temporal Proximity: The order was issued shortly after key FOIA requests were filed and, more significantly, immediately following a Federal OCR complaint and documented reports of intimidation involving a student.

  • Expansion to Digital Platforms: The order was subsequently expanded to bar me from all LCPS digital platforms, explicitly cutting off my access to the FOIA portal. This action directly followed LCPS accepting payment for records but before producing them. By utilizing police power to enforce this "Digital Blockade," LCPS effectively prevented me from obtaining evidence already paid for and defaulted on.

  • Material Breach and Larceny by Trick: This combination of accepting payment and then deliberately blocking access constitutes a Material Breach of contract and raises serious questions about Larceny by Trick (Va. Code § 18.2-178). The FOIA Advisory Council has already provided an informal opinion confirming the material breach.

Section 3: Direct Harm to Protected Students and Parental Rights

Most disturbing are the direct consequences of this coordinated obstruction on my children and my ability to parent effectively.

  • Retaliation Against Students: Evidence suggests this entire campaign is partially in response to my son Charles reporting intimidation by an LCPS administrator. This occurred after an OCR complaint was filed. Furthermore, LCPS willfully violated my explicit revocation of consent for Charles's transport, illustrating a blatant disregard for parental authority and student safety protocols. Both my children are protected under IEPs, adding a layer of concern regarding retaliation against protected students under Section 504 and the ADA.

  • Interference with Visitation: The retaliatory nature of the No-Trespass order has now escalated to include direct interference with court-ordered visitation. By scheduling student events exclusively at LCPS facilities (which I am barred from entering) during my parenting time, a manufactured conflict has been created, resulting in a de facto loss of visitation. This coordination with a state actor to achieve a private family law outcome is a severe violation of fundamental rights.

Conclusion:

The evidence documented through FOIA requests (and subsequent defaults), OCR complaints, and direct correspondence illustrates a concerted effort by LCPS administrators, in concert with private attorneys and corporate vendors, to silence whistleblowing activity and obstruct legitimate inquiry. The use of police power (through the No-Trespass order) and the baseless assertion of privilege are not legitimate security or legal measures; they are retaliatory strikes designed to protect unlawful activity from exposure. This pattern of behavior has now directly harmed protected students and interferes with court-ordered parental rights, a situation that cannot be ignored.

The record is clear, and the necessary steps are being taken to bring these violations to the attention of the appropriate federal, state, and ethical oversight bodies. This is not just a FOIA dispute; it is a battle for transparency, accountability, and the protection of basic civil rights within our public institutions.
