Long-Distance Tyranny: Does the 14th Amendment Apply 700 Miles from Loudoun?

Today, Superintendent Aaron Spence sent a mass email championing the 14th Amendment and the Equal Protection Clause. He promised that LCPS is a "safe, affirming place" where students can learn "without distraction or fear."

For my family, this isn't just a lie—it's a 700-mile reach of administrative abuse.

The "Authorization" Myth Dr. Spence tells the public that "Federal law enforcement agents do not have access to our schools without proper legal authorization." That sounds great in a press release. But where was the "proper legal authorization" in December 2023, when Principal Nick Cottone and private attorneys used a School Resource Officer (SRO) to hunt down a parent in Chicago, Illinois

Why am I not allowed to enjoy the same legal protections under the 14th amendment that immigrant families attending LCPS do? I am a U.S. Citizen and should rightfully expect to be treated with respect for my rights and the law by all parties employed by Loudoun County Government, including but not limited to LCPS and LCSO. 

Interrogation via Long-Distance The District didn't just allow an SRO to walk the halls; they allowed him to use LCPS phones and email to initiate an extrajudicial interrogation of a father 700 miles away. There was no threat to the school. There was no "safety" concern. LCSO Officer Iversen even explicitly stated that there was no criminal investigation and in reality absolutely no legitimate reason for him to email or call me. In fact, he explicitly stated the only reason to call me was to intimidate me regarding my recent communications with Nick Cottone of Seneca Ridge Middle School, and Kate Ridgeway of Lowes Island Elementary School. There was only a "Tripartite Nexus" of school executives and private lawyers (Troxell Leigh) who wanted to use a badge to silence a whistleblower.

The FERPA Shield vs. The 944 Records Spence cited FERPA as a shield for student privacy. Meanwhile, his FOIA office just admitted to holding 944 records of coordination between LCPS and private lawyers. If FERPA is sacred, why are my family's private details being traded like currency between your staff and attorneys Lindsay Mohler and Gareth Bowen?

A Standard of Care... for Some By sending this email, Dr. Spence has established a Standard of Care. He has publicly committed to education without "distraction or fear."

I am holding him to his own standard. If the 14th Amendment protects the education of every child, it must protect my children from the administrative fraud of Principal Nick Cottone. It must protect my family from a District that thinks its jurisdiction—and its ability to intimidate—extends all the way to Chicago.

The most important aspect of this situation is that Lindsay Mohler and Troxel Leigh P.C. were allowed to collaborate with LCPS and LSCO to obtain their help in driving a private civil matter being developed. The collusive contact described here all occurred prior to any legitimate legal matter occuring. 

In other words, LCPS and LCSO were weaponized to manufacture positive standing in favor of attorney Lindsay Mohler and Troxel Leigh P.C. 

John Whitbeck failed to listen to me that the evidence he had uncovered was in fact unlawful, as the communication and collaboration occurred prior to any legal reason existing to have such discussions.

Good afternoon, LCPS families and staff,

In light of recent news reports and enforcement actions happening across the country, many of our families and students have shared concerns about the potential for increased federal immigration enforcement activity here in Loudoun County. 

I want to take a moment to acknowledge those concerns and to reassure our entire LCPS community that Loudoun County Public Schools remains committed to ensuring that every student and family feels safe, supported, and welcome in our schools.

As I shared in a message last year, we follow the law. The 1982 Supreme Court ruling in Plyler v. Doe guarantees all children, regardless of immigration status, access to public education. This decision, rooted in the 14th Amendment’s Equal Protection Clause, underscores the vital role of public schools in shaping the future. Additionally, the Family Educational Rights and Privacy Act (FERPA) protects the privacy of student information and prohibits LCPS from releasing students’ education records, except in very limited circumstances prescribed by law.

While we are limited to how much we can share about LCPS's safety and security operational protocols and practices, in the interests of ensuring public safety, I can definitively share that Federal law enforcement agents do not have access to our schools without proper legal authorization, and all visitors are subject to established security protocols designed to protect students and staff.

Both staff and families who are dealing with fears or emotional challenges as a result of any issue in our community have access to support resources, including through our school Unified Mental Health Teams and our staff EAP services. Families can reach out directly to their school principals to request this support and explore additional mental health resources offered by LCPS.

We will continue to communicate openly with our community and remain dedicated to creating a safe, affirming place for every learner and family we serve.
