FORMAL DEBARMENT REQUEST & ANTI-RETALIATION NOTICE

I sent this correspondence to LCPS CFO this morning, Thursday, February 19, 2026, and will escalate the issue with the appropriate state agencies I have listed below 

FORMAL DEBARMENT REQUEST & ANTI-RETALIATION NOTICE

TO: Sharon Willoughby (CFO); Cheryl Middleton (Purchasing); LCPS Division Counsel 

DATE: February 18, 2026 

RE: FORMAL REQUEST FOR VENDOR DEBARMENT (QlikTech, Inc.) & NOTICE OF PROTECTED ACTIVITY 

STATUTORY BASIS: VA Code § 2.2-4321; Section 504 (34 C.F.R. § 104.61); LCPS Policy 7561

I. ADVERSE VENDOR COMPLAINT (QLIKTECH, INC.) Pursuant to the Virginia Public Procurement Act (VPPA), I formally request that LCPS initiate debarment proceedings against QlikTech, Inc. for a demonstrated lack of business integrity.

  • Documented Misrepresentation & Coordinated Fraud: Per the attached Montgomery County, PA Case #2024-17511 and the May 15, 2024 correspondence from Troxell Leigh P.C., QlikTech provided fraudulent employment data to private counsel. Specifically, an email dated May 10, 2024 (Bates No. ELE 0032) from Qlik Legal was utilized by attorney Lindsay Mohler to falsely assert my departure was "self-volunteered"—directly contradicting Qlik’s own January 17, 2023, severance records and Pennsylvania unemployment filings.

  • Weaponization of Misrepresented Data: As shown in the attached May 15, 2024, letter, this fraudulent data was used to coerce an unfavorable settlement and justify the denial of a reduction in child/spousal support in Case No. CL21-6851-02.

  • Data Suppression: As evidenced in the attached Subpoena Response, Qlik willfully redacted and suppressed records regarding documented reports of threats of physical violence (Ref: counterpart Jason Lovinger).

  • Nexus to $2,148,000 and Continuing Liability: This pattern of coordination to manufacture adverse narratives directly informs the February 13, 2026, Qlik Data Deletion event occurring during an active VDOE/OCR investigation.

II. LEGAL SHIELD & ANTI-RETALIATION DECLARATION This submission constitutes a Protected Activity under Section 504 of the Rehabilitation Act, the IDEA, and LCPS Policy 7561.

  • Notice of Non-Neutrality: I am documenting institutional retaliation facilitated by the "Public-Private Nexus" between LCPS, Troxell Leigh P.C., and Lindsay Mohler.

  • Pre-emptive Defense: Any attempt by QlikTech Inc., Troxell Leigh P.C., Lindsay Mohler, or District officials to seek civil or criminal penalties in response to this disclosure will be treated as Aggravated Retaliation.

  • Personal Liability Notice: Pursuant to VA Code § 2.2-3713, officials participating in the suppression of records or retaliation against a whistleblower may be held personally liable for civil penalties.

III. NOTICE OF INTENT TO ESCALATE TO STATE OVERSIGHT Be advised that I am concurrently filing formal procurement and integrity complaints regarding this vendor-counsel nexus with the following state agencies:

  1. Virginia Office of the State Inspector General (OSIG) (Fraud, Waste, and Abuse).

  2. Virginia Department of General Services (DGS) (Procurement Integrity).

  3. Office of the Attorney General of Virginia (Consumer Protection/Antitrust).

DEMAND FOR IMMEDIATE CORRECTIVE ACTION & PRESERVATION: To mitigate further civil rights and tort liability, I demand the following immediate actions:

  1. Administrative Removal: Initiate immediate leave and termination proceedings for Principal Nick Cottone for Administrative Fraud.

  2. Vendor Suspension & Debarment: Suspend QlikTech, Inc.’s status as a "Responsible Bidder" and initiate permanent debarment proceedings based on the attached evidence of misrepresentation and coordination with private counsel.

  3. Statutory Bond Requirement ($2,148,000.00 and Continuing): Demand QlikTech, Inc. post a performance bond to cover the accruing damages resulting from their lack of administrative neutrality.

  4. Formal Preservation Order & Forensic Audit: A district-wide freeze on all Qlik-managed data related to Charles Rubis and communications involving Troxell Leigh P.C. A third-party forensic audit must be conducted regarding the February 13, 2026, mass data deletion event.
