Last night, I published a forensic deep dive into the "Tripartite Nexus"—the documented collusion between the Loudoun County Sheriff’s Office (LCSO), Loudoun County Public Schools (LCPS), and the private law firm Troxell Leigh P.C.
The response from the Sheriff’s Office was swift, but not in the way of transparency. This morning, LCSO FOIA Coordinator Maryellen Clarke issued a notice to "toll" (pause) my request for records regarding Deputy Timothy Iversen and the December 12 "Warning Call."
The Pretext: The Residency Trap Despite my providing objective, government-issued evidence of my standing in the Commonwealth—including Virginia tax records and Virginia vehicle registration—Ms. Clarke has ruled these insufficient to verify residency.
This is a classic "Gatekeeping" tactic. By refusing to accept standard benchmarks of state residency, the Sheriff’s Office is attempting to create an indefinite blackout of information.
Why are they tolling now? The timing is not a coincidence. This administrative hurdle was erected less than 24 hours after I exposed the following:
The Subpoena Trigger: Evidence that LCPS administrators were subpoenaed on April 24, 2024.
The Remedial Action: The fact that Deputy Iversen was abruptly transferred 72 hours later.
The Admission: Internal HRTD emails admitting the Iversen matter was "previously addressed."
A Message to the Gatekeepers Under Va. Code § 2.2-3704(A), residency requirements are waived for representatives of the news media broadcasting into the Commonwealth. As an investigative publisher, my physical address is irrelevant to my right to oversee the conduct of public officials who use their state authority to intimidate private citizens.
The Sheriff’s Office is not just blocking a father; they are attempting to censor a journalist.
I have formally escalated this matter to the Virginia FOIA Council for an Advisory Opinion. If the LCSO believes they can "toll" their way out of accountability, they are mistaken. Sunlight is coming to Loudoun.
