LCPS FOIA Request Uncovers Fraudulent Activity and Intentional Professional Misconduct Undertaken by Nick Cottone Principal of Seneca Ridge Middle School

In December 2025, I submitted a FOIA request regarding Nick Cottone in order to evaluate and uncover any documentation Mr. Cottone created to justify his utilization of the School Resource Officer Tim Iversen to interrogate me on December 12, 2023.

The FOIA request uncovered an email sent by Mr. Cottone to both Mr. Gus Martinez and Ms. Beth Robinson. His email represents blatant fraud and intentional professional misconduct. 

I have proven via LCPS FOIA requests that a significant email communication trail exists between my ex wife and Mr. Cottone. The email trail occurred during August and September 2023. The emails illustrate a deep relationship. Based on the emails, Mr. Cottone clearly knew who my ex wife was, had a more than name only relationship, and even established a telephonic relationship with her where she could call at her convenience to him. I was not afforded the same beneficial relationship.

Here is the email Nick Cottone sent to Gus Martinez and Beth Robinson:

The email illustrated above sent by Nick Cottone via his LCPS.org email address represents fraudulent activity and intentional professional misconduct designed to not only harm me a parent of his student, but an attempt to have me charged with a crime and restrict my parental rights. Furthermore, the email above represents that Mr. Cottone undertook blatant activity to set me up to have me improperly interrogated by his School resource officer on December 12, 2023, four days after being served with a lawsuit from my ex wife, and four days after emailing Nick Cottone I was served with a lawsuit including our private communications.

Furthermore, I can show that emails exists whereby Nick Cottone explicitly stated that he would help my ex wife obtain a private commuincation I sent him, which was subsequently used in a lawsuit filed against me by my ex wife in Loudoun County District Courty by Lindsay Mohler of Troxel Leigh.

Please note that on October 24, 2023, there were no legitimate legal reasons that existed for Principal Nick Cottone to have a call or discussion with Gareth Bowen of Troxel Leigh, on behalf of Lindsay Mohler of Troxel Leigh.

A. Proof of Malice and Deceit

Cottone did not merely "handle" a difficult parent; he deceived his supervisors about his neutrality. A Principal who is honest with his superiors would disclose, "I have been in contact with the other parent's counsel regarding this family matter." By hiding the relationship, he proved he knew the relationship was inappropriate or a conflict of interest.

B. Abuse of Process (The SRO)

You can now argue that the SRO activation was not a response to your conduct, but a pre-planned maneuver to support the lawsuit served just four days prior. The October 13th email proves he was looking for "next steps" to handle you as a "concerning" individual long before the SRO incident occurred.

C. Violation of VFOIA and Privacy

If he shared your private email with your ex-wife's attorney without a subpoena or legal mandate—while telling his bosses he had no relationship with you—he likely violated the Virginia Privacy Protection Act or LCPS policies regarding the handling of sensitive parent communications.

The story discussed the fact that Principal Nick Cottone of Seneca Ridge Middle School had activated his School Resource Officer to have a special education teacher arrested under suspicion that she was drunk.
